Wedding Contract


In the following terms & conditions “the photographer” shall mean Yvonne James trading as Yvonne James Photography. “The clients” shall be those persons defined as bride and/or groom on the booking form. These terms & conditions cannot be varied in any way by the clients unless such conditions are expressly agreed by the photographer in writing.


Booking Fee / Deposit Payments

A non-refundable payment of £100 as well as full acceptance of the terms and conditions as published on is needed at time of booking.  This payment secures the time and the services of the photographer for the wedding and is non-refundable or transferable in the event of cancellation.

The payment made of £100 will be deducted from the clients chosen package when calculating the final balance due.  The final balance due will be due to be paid no later than 28 days before the wedding day.  Weddings that are postponed to a later date will retain the fee as long as the photographer can re-schedule for the new date and time.  Additional goods must be paid for in full at the time of ordering.

If the wedding is booked less than a year prior to the wedding date there may be a 10% monetary increase in the package prices due to normal inflation and price increases. Any weddings booked over a year in advance will only incur a 5% increase of the original price.  The increase will be applied exactly 12 months from the date the wedding is booked.

When payments are due an invoice will be sent via email and payments must be paid within 5 days of invoice being sent.

If payments are not made by the wedding date then the photographer will not be attending the wedding.



The client may cancel this contract at any time by giving written notice to the photographer but in doing so shall forfeit any monies paid as follows:

Cancelled before and up to 90 days before the wedding date – booking fee is retained by the Photographer

Cancelled up to 28 days before the wedding date – booking fee is retained and 30% of remaining balance needs to be paid to cover loss of earnings as the Photographer will be unlikely able to fill that date with a session of the same value.

Cancelled between 28 days and 14 days of the wedding date – booking fee is retained and 50% of remaining balance needs to be paid to cover loss of earnings as the Photographer will be unlikely able to fill that date with a session of the same value.

Cancelled between 13 days and 0 days of the wedding date – booking fee is retained and 75% of remaining balance needs to be paid to cover loss of earnings as the Photographer will be unlikely able to fill that date with a session of the same value.

Cancellations must be made in writing.



The copyright Designs and Patents Acts assign the copyright of the images to the photographer.



The client ( s ) hereby allow ( s ) the photographer to display any photograph covered by this contract and to generally promote the business in advertising,  brochures, magazine articles, websites, social media, sample albums etc.

A sneak peek of one image is available and can be put on social media within 24hrs of the wedding date, if the clients do not wish for this they must inform the photographer in writing prior to the wedding.



Photographs taken during the course of the event will be at the discretion of the photographer although every effort will be made to comply with the clients requirements.

The photographer shall be granted artistic license in relation to the poses photographed and the locations used. The photographer’s judgement regarding these matters shall be deemed correct.

The photographer shall endeavour to photograph all individuals as requested by the client(s) at some point, but no responsibility will be taken by the photographer on the occasion of leaving somebody out.   If the weather affects the ability to obtain photographs outside the photographer will do the best in their ability to obtain the required images in alternative locations such as indoors, under cover etc…

For a booking involving a church ceremony or at certain venues, the photographer’s movements are sometimes restricted by the official in charge. The area from which the photographer is able to cover the ceremony may not be the photographer’s choice and the photographer cannot accept responsibility for any obstructed view should this be the case.

During a ceremony, it is often the case that guests stand in the aisle or move around to obtain photographs with their own camera’s or phones – this can impede on the photographer’s ability to get the best shots of the service.  The photographer will always suggest that guests are asked to avoid doing this.  The photographer will not be held responsible if this occurs and prevents moments from being captured.

Due to a variety of lighting conditions and the limitations of digital sensors, some colours may alter throughout a set of photographs.


On the Day

The Photographer is the only authorised and official photographer for your wedding day, if any other photographer arrives at the event the photographer will no longer continue.

If any guests at the event impede the photographer’s ability to do their job the photographer will discuss these concerns with the clients with the expectation that it will stop.

If the wedding is for over six hours coverage the Photographer will have a minimum of a thirty-minute refreshment break.

If the wedding is over eight hours coverage then the Photographer will have a minimum of a one-hour refreshment break and will expect food to be provided by the clients, this does not have to include a meal the same as wedding guests.

Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, the photographer will not be responsible for photographs that are not produced due to technical failure.

The photographer has all relevant insurances needed.
After The Big Day

Your images will be edited within 28 days of your wedding day and displayed for you in a password protected online gallery, this gallery will be active and available for viewing for no more than 14 days.  If the Client wishes to purchase any other products (not included in the package chosen) then these items need to be paid for and ordered prior to the end of the 14 days.

Delivery for products is 10-14 working days from the date of payment ( unless otherwise stated at the time of ordering such as the Photographer is taking holiday etc ).


Retouching / Printing

All images will be adjusted for exposure, brightness, contrast, sharpness, etc The Photographer’s judgement regarding these corrections and the number of images put forward to the Client for preview shall be deemed correct.

Retouching, digital manipulation and artist finishing is available to the Client as an option at extra cost of £10 per image.

When printing your photos please note Yvonne James Photography cannot be held responsible for poor quality prints from high street or online printers. Yvonne James Photography can provide you with professional prints, please contact me to discuss the price of these.


Force Majeure

The due performance of this contract is subject to alteration or cancellation due to a Force Majeure Event.  A Force Majeure Event means an event beyond the control of a party, which by its nature could not have been foreseen or, if it could have been foreseen, was unavoidable, and includes, without limitation, storms, floods, riots, fires, sudden illness, injury, victim of crime etc…  For the avoidance of doubt, it does not include circumstances where the Photographer attend an Event to perform the Services and any of the Parties fail to attend –  Cancellation.

In the unlikely event of the assigned Photographer being unable to attend your wedding due to unforeseen circumstances, the photographer will put the client in touch with another photographer to attend on the wedding date.

In the event of cancellation by the photographer, or in the very unlikely event of total photographic failure, liability shall be limited to a full refund of any fees paid.



All standard wedding packages and additional goods specified on the booking form are supplied at the prices ruling on the date of booking. Goods not specified on the booking form are supplied at the prices ruling at the time of receipt of the order.


Personal Accident

Any directions issued to clients, their guests or employees during a photographic shoot are deemed to be at said persons own risk. The photographer cannot be held responsible for any personal accidents during a photographic shoot.   All relevant insurances are held by the photographer.


All images are copyrighted to Yvonne James Photography, even those you have purchased. You will receive a print release to allow you to print the photos. You are also permitted to use the photos on social media and to share with family and friends. They must not be used for commercial gain unless permission has been agreed.

The Client may not alter or add to or manipulate a picture by means of computer or any other technique including Instagram filters or reproduce a picture in whole or in part as an element within, or as a montage with, another picture.

Yvonne James Photography reserves the right to use any photographs taken during your session in any form such as but not limited to the use in advertising. This includes on Yvonne James Photography’s website, social media, brochures, magazine articles, websites, sample albums and future advertising campaigns or marketing materials. If you do not want your images to be used for this purpose, please inform Yvonne James Photography prior to your photo shoot.

Governing Law

This agreement shall be governed in accordance with the laws of England and Wales.

Model Release

I, the client, confirm and accept that Yvonne James Photography will own the copyright to the images and use them for the purposes of business as listed above.

Guests at your wedding will have assumed agreement that they may feature in prominently or in the background of images taken on your wedding day – this in most circumstances can not be avoided.  However if there are any guests who do not wish to be photographed then they must make the photographer aware on the day.


Personal Information – Data Protection

 Any personal information given to Yvonne James Photography will only be used for contact between the photographer and the client. Your details will never be passed on to other companies without your consent.

Your gallery of images will be kept for safekeeping for up to 12 months from the date your gallery is activated, with some being kept for up to 60 months (5 years) for business purposes.

Images are kept on a secure password protected data cloud as well as backed up on a secure external hard drive.

Your personal information will be kept for 24 months (2 years) from the date your gallery is activated.

This information is not shared with any other business or company and is only used by Yvonne James Photography for the purposes of running a business.
